'So You Think You Can Dance' Goes Hollywood

Characters rule in the L.A. leg, with Marshea Kidd and Cole Horibe especially impressing the judges.

"So You Think You Can Dance" returned with its third round of auditions, landing smack in the middle of LaLa Land. Characters ruled in the Los Angeles leg of the competition, in an episode reminiscent of a Hollywood blockbuster. Guest judge Jesse Tyler Ferguson of "Modern Family" joined judges Nigel Lythgoe and Mary Murphy in narrowing down the dancing field.

While hip-hop, animation and exorcism ruled in the season premiere of "SYTYCD," the second episode was saturated with contemporary routines full of sensuality, sadness and ... martial arts? It was the dancers' unique personalities that brought their talents to life.

Starlet
The heroine came early but left a serious mark with the judges. Eliana Girard, a trained dancer, circus performer and pole dancer, wowed the judges with her mile-long legs and emotional connection to the dance. Murphy said Girard was "Definitely top 20 material," while Lythgoe commented, "You are one of the best girls this year." Girard received a standing ovation and a sweet golden ticket to Vegas.

Comic Relief
Jontel "Johnny Waacks" Gibson — need we say more? "I think I was born in the wrong era," Gibson said of himself in his intro package as he donned a bright '70s-inspired outfit to go with his revival of the dance style "waacking." More than his dance, Gibson had the judges splitting with laughter as they made reference after reference to the sexual innuendo behind the word "waacking." The waacking routine was not the first in the show's history, and Gibson did not make it through to Vegas after falling flat in the choreography round.

Stunt Doubles
Hilarity ensued upon the arrival of twin brothers Nick and James Aragon, a.k.a. the "Ninja Twins." The athletes-turned-dancers entertained to the max with their twin jibber jabber — finishing each other's sentences, speaking simultaneously and ribbing one another about who was the "best." After their joint performance, Lythgoe exclaimed, "You have made this show for me, right now." Unfortunately, the eccentric siblings were two years too old for the 30-year eligibility cutoff required and could not make it through but were praised for their talents and told to get a reality show.

Victim
Every story has a victim, and in this episode, it was 18-year-old Sam Lenarz. After multiple disagreements with her mother, the teenager was thrown out of her home and taken in by her best friend's family. The pain of the ordeal was evident in her performance. Jesse Tyler Ferguson pointed out that her routine was laden with "simmering sadness, in a beautiful way." Things turned up for Lenarz after she was granted a go-ahead to move on in the competition.

Action Hero
Cole Horibe proved to be more than a pretty face, as most action heroes do, with a martial-arts-infused dance that showed off his inhuman strength and control. Performing with extreme precision, the judges called Horibe's legs "lethal" and without blinking offered him a ticket to Vegas. The decision was easier after Horibe jokingly threatened to come after the judges if they didn't.

Villain
What story would be complete without a villain? OK, a reformed villain, to be precise. And Wednesday night's came in the form of Jonathan Anzalone, a former contestant from season four who returned to humble himself after his first audition debacle on the show. Anzalone was criticized for his arrogance and returned to prove to the judges and the world that he had matured and respected their decisions. Their final decision: good, but not good enough. Anzalone was not allowed to move on.

Scene-Stealer
The real scene-stealer of the night, though, was Marshea Kidd. The 22-year old had auditioned unsuccessfully in seasons past but returned with a whole new take on dance and life. Kidd had survived a horrific car accident just six weeks prior, pronounced dead on arrival to the hospital. His "SYTYCD" audition was his first time onstage after breaking his neck and coming out of a coma. Kidd's beautiful performance illuminated the stage and his new zest for life was felt by all in the room. Speechless, the judges merely waved a golden ticket in front of Kidd and reduced him and his family to tears.

The dancers in Los Angeles more than lived up to the judges' expectations and took the show further with their diverse characters. "So You Think You Can Dance" returns next week in the Dirty South.

Tim Cook: 'I want there to be' Apple products made in America

Apple CEO Tim Cook is currently being interviewed by AllThingsD's Kara Swisher and Walt Mossberg, and took time to answer the question of whether or not Apple is interested in manufacturing any of its products domestically. While pointing out that it does source components locally, including glass for the iPhone made in Kentucky as well as CPUs for the iPhone and iPad made in Austin, Texas by Samsung, Cook indicated he "hopes" final assembly could be done in the US. Initially repeating "I want there to be [manufacturing in America]," he closed with "we will do as many of these things as we can do [in America], and you can bet that we'll use our influence to do it." What Small Business Can Learn From Google

When I talk to people about Google and its organizational culture, they are equally fascinated and hopeless, believing that the magic behind Google lies in the deep revenue streams that make it possible to feed its employees three meals a day. Small businesses, especially, tend to dismiss Google as a wholly unattainable model for running a business.

However, I learned core lessons at Google that transformed the way I look at problem solving and strategic thinking. There were statements that I heard early and often that guided decision-making at every level of the organization. These mantras are at the core of innovation for Google but translate readily to any business to create agility, employee engagement and ultimately, stronger business results. Google's success owes far more to these mantras than the food in the cafes, and even better, they cost no money to implement.

Distilling trade dress law: Sixth circuit rules Maker's Mark dripping ...

Trademarks are one of the most essential building blocks to a franchise brand.?We all immediately recognize what the Golden Arches, the block red ?GNC?, or the Sheraton ?S? surrounded by a sprig of mountain laurel represent.?So, we took great interest in a number of recent trademark decisions involving the spirits industry.

Alcohol packaging and trademark/trade dress law have intersected quite a few times in the news this month. ?First, as?Daniel Corbett?recently reported, the maker's of Daily's cocktails?sued Captain Morgan producer Diageo North America Inc. in a suit alleging that Diageo's single-serve cocktail pouches infringed the plaintiff's?design patents?and trade dress.

Then, the U.S. Court of Appeals for the Sixth Circuit ruled in favor of Maker's?Mark Distillery, Inc. in its?complaint alleging that the makers of Jose Cuervo tequila infringed Maker's Mark's trademark and trade dress rights by?featuring a bottle having a dripping red wax seal. ?In an opinion that provides not only a discussion of trade dress law but also an?entertaining?history of American bourbon manufacturing, the Court considered whether the dripping wax seal was entitled to trademark protection and concluded that the answer was 'yes".

In its defense, Cuervo argued that the seal could not be protected because it was "aesthetically functional." ?The Court noted that "a?trademark is functional 'if it is essential to the use or purpose of the?article or if it affects the cost or quality of the article.'" ?Although the Court did not affirmatively state whether or not it even recognized the doctrine of aesthetic functionality, it upheld Makers' Mark's rights because others could easily sell their products without using the dripping red wax seal:

The district court was not?convinced ?that it would be difficult or costly for competitors to design around? the mark?and we do not disagree. There is more than one way to seal a bottle with wax to make?it look appealing, and so Cuervo fails the comparable alternatives test. As to the?effective competition test, the district court found that ?red wax is not the only pleasing?color of wax . . . nor does it put competitors at a significant non-reputation related?disadvantage to be prevented from using red dripping wax.

Noting that the USPTO awarded Maker's Mark a trademark registration for a non-color-specific version of the seal in connection with other food products, the court then turned to the question of infringement. ?Makers' Mark argued that Cuervo's use of the red dripping wax seal on tequila created "confusion of sponsorship" as to the source of the goods. ?Although there was no evidence of actual consumer confusion, the Court found that Makers' Mark's trade dress rights were strong due to over 50 years' use of the dripping red wax seal. ?The Court also found similarity between the accused and original marks, as well as relatedness in the goods, although the Court gave these factors less weight than it gave to the strength of the mark. ?On this basis, the Court ruled in favor of Makers' Mark.

The opinion provides some guidance for companies who offer products that may appear to be similar to competing products. ?First, although Markers' Mark held a USPTO trademark registration for the dripping bottle seal, the registration was color-agnostic and only listed steak sauce (not alcohol) ?as the relevant goods. ?Thus, the opinion indicates the absence of a USPTO registration ?covering the goods in question does not necessarily mean that a party is not entitled to trademark or trade dress rights if the mark is sufficiently strong.

Second, the Court's focus on strength of the mark shows that consistent use of a trademark over time, along with extensive marketing efforts, can provide a trademark owner with substantial leverage when others use similar marks.?These cases reinforce what we?ve always believed:?franchisors, suppliers and others who own trademarks should adopt and enforce strict and consistent trademark usage policies before allowing others to use those marks. ?Otherwise, the trademark owner may end up with little or no trademark rights -- and no ability to keep infringers out of the market.

Setup an Additional Phone Number on a Android Smartphone or iPhone

When you get an iPhone or Android based smartphone, like any other cellphone, you activate the line with a specific phone number. However, what if you want to have an additional phone number for your phone? Using the iPhone?s/Android?s required data plan in combination with an app, you can setup a secondary phone number that will also ring, dial out and video chat for your smartphone.

There are a few different ways to add additional phone numbers to a smartphone. Your wireless carrier may be able to set this up for you, you may able to use call forwarding to receive calls from another phone or landline on your smartphone, and there are even some dedicated services that specialize in adding additional lines to a smartphone.

However, most of these services or plan add-ons cost money, and for how much you will actually use the additional line, it may not be worth it. The following method for adding a second phone number to an iPhone or Android smartphone is free and simple to setup.

To get started, jump to the Google Voice homepage and sign-in to your Google account. Once signed-in, Google will present you with the following prompt:

Select the option I want a new number. On the next screen, you will be prompted to choose and setup the Google Voice number. Enter your area code, zip code or city and click the Search numbers button.

From here, Google will present you with a list of available phone numbers to choose from. Select a phone number you would like to use and click the Continue button.

You will also need to select a pin that will be used to access your voicemail for the new number. Enter a pin number and click the Continue button.

Finally, you will need to enter a forwarding phone number. For this, you can enter your home, work or cell phone number. Most people will simply want to enter their existing smartphone/cell phone number, as this tutorial is based on adding an additional number to a smartphone. Click the Continue button to proceed.

Finally, Google will need to verify your phone setup. Click the Call me now button.

Enter the verification code when Google calls you. Once that has been done, your account will be activated. Click the Finish button.

Now that you?ve successfully setup Google Voice, you can test it by simply dialing the number that Google Voice provided for you. From there, it should directly ring your smartphone, home phone or work phone (whatever phone you entered during setup).

Basically, now you have a Google Voice number which is forwarded to the phone number you chose. You can access the phone number and some additional settings from your Google Voice homepage. However, there is still not yet video chat and other features, and when you dial out from your smartphone, it will be your normal number not your Google Voice number. Now, we need to download some apps:

iPhone ? Vtok

Android ? Google Voice

Proceed to download and install one of the above apps, depending whether you have an Android based smartphone or iPhone. Because these apps are Google Voice integrated, they will provide for you an entirely new phone interface, just for your Google Voice number.

That?s basically all there is to it. If you just want basic call forwarding from your Google Voice number, you do not need to download any apps, simply setup Google Voice.

However, if you want an actual, full-featured additional phone number for your smartphone, download an app, which provides a unique calling, texting and video chat interface just for that specific, additional Google Voice number. Then, you can of course use your iPhone the way you normally would with your default mobile phone number, but also use the Google Voice app for the additional phone number that was setup during this tutorial. Is Your Water Bottle Giving You Cancer? New Study Reveals Shocking BPA Dangers

Bisphenol A, or BPA for short, has been in the spotlight for decades, with both the chemical industry and occasionally the federal government touting its safety, while independent, non-industry funded scientific studies show us how dangerous the chemical truly is. The latest news regarding BPA is no different, with new independent studies showing that the common chemical has the potential to increase the risk of breast cancer when exposure occurs in the womb.

BPA is a common chemical used primarily in the production of plastics, such as baby bottles, canned goods (lining the inside of cans), soda bottles, and other common plastic goods that typically hold food or beverages (although it is found in countless other polycarbonate plastic products, including medical devices). It helps preserve the life of perishable goods, but comes at a dangerous cost to human health.

The chemical easily leaches out of plastic, and is either consumed by humans, or it can be absorbed through the skin. Estimates show that in the U.S., humans consume about 50 micrograms per kilogram of body weight everyday. The Centers for Disease Control (CDC) estimates that, at any given time, 93% of Americans have measurable amounts of BPA in their systems.

The latest study, released earlier this month, shows that in utero exposure to BPA in rhesus monkeys led to abnormalities in mammary gland?development.

This new study involved fetal BPA exposure, revealing chemical alterations in rhesus monkey mammary gland development, said the San Francisco Gate (SF Gate). For the study, researchers fed pregnant rhesus macaques monkeys a piece of fruit that contained BPA every day during their third trimester of pregnancy.

The monkeys? BPA blood levels reached the average level that BPA has been observed in human blood in the U.S., according to Patricia Hunt, a geneticist at Washington State University and a study author, said the SF Gate. The changes observed reinforce concerns that BPA could contribute to breast cancer, according to the team.

The researchers studied the mammary glands of the female offspring of BPA-exposed monkeys and discovered changes in those glands that lead to dense tissue, said the SF Gate. Dense breast tissue is a risk factor for human breast caner, Hunt explained. Prior and new studies conducted by Ana Soto and Carlos Sonnenschein, revealed that exposing rodents to small amounts of BPA could alter mammary gland development and lead to precancerous and cancerous lesions later in life.

Ana Soto, a co-author of the new study who has worked on previous BPA studies, said that this new information strongly suggests that ?BPA is a breast carcinogen in humans? and that exposure must be curtailed.

The breast cancer link is just the latest in the chain of health hazards associated with BPA. The Journal of the American Medical Association (JAMA) reported in 2008 that exposure to BPA was linked to an increase in cardiovascular diseases, type 2 diabetes, and liver enzyme abnormalities. And these effects were seen at relatively low-dose amounts of BPA, well below the amount actually consumed by Americans on a daily basis.

Many companies, including Playtex, Gerber, and several baby bottle manufacturers have voluntarily stopped using BPA in their products, as there are currently no national bans on the chemical. To understand why no bans exist, you have to follow the money.

Companies that manufacturer BPA ? including Dow Chemical and Bayer ? are bringing in a combined $6 billion a year selling the product. And that money has been put to good use convincing the American public that there is nothing to worry about.

In fact, they?ve done such a good job with their PR campaigns that they managed to convince the EPA to base their decision on whether or not the chemical is toxic on the industry?s own studies. Every single industry-funded study has shown that BPA is ?completely harmless,? compared to only 10% of independent studies that found no cause for concern.

One of the main defenders of BPA has been the American Chemistry Council (ACC), the leading front group for the chemical industry. To give you a hint at how their operation works, their former president is Jack Gerard, the current president of the American Petroleum Institute. The organization has spent millions of dollars in the last few years to defeat measures by the EPA to regulate the chemical more stringently, all of which were, predictably, dead on arrival.

In 2010, ACC spent almost $10 million in California alone to defeat measures aimed at curtailing BPA usage.

But the failure of the government doesn?t mean all hope is lost.

Consumers have some power to prevent BPA exposure. Choosing BPA-free products can help prevent exposure, as can purchasing fresh vegetables instead of canned items.

This article provides a few more tips on how to take preventative measures. As long as the industry is funneling money into Washington, the only regulation will come from consumers themselves, who can vote on this issue with their own wallets.?

Speaking of wallets, BPA is also used to coat the receipt paper that ends up contacting human skin at cash registers around the world. And a new study shows that the replacement for BPA, known as Bisphenol S, may also pose significant health risks.?

So while the consumer can take some steps to limit exposure, it truly falls to the government to investigate and protect consumers from these harmful chemicals. That will require getting rid of the influence of industry cash flowing into politicians' coffers, the most powerful contaminant of all in our democracy these?days.?

Police Chief Michael Meehan told the Oakland Tribune?on Wednesday no preferential treatment was given when the officers, including three detectives and a sergeant, searched for the phone, which was taken from a school locker in January.

Meehan says field supervisors decide how many officers to put on a case and he's confident the search was properly handled.

The police chief also came under scrutiny in March after ordering an officer to a reporter's home to ask for changes to an online story about a community meeting criticizing the alleged slow police response to an elderly man's beating death. Meehan apologized.

Mountain lion killed in Santa Monica was probably seeking a home

In the end, the mountain lion was probably looking for a place to call his own.

Scientists believe the male mountain lion roamed his way down the Santa Monica Mountains early Tuesday, likely following a runoff channel. When daylight broke, he found himself in the middle of the city and scared.

The lion was 3, and experts said that was the age to carve out his own territory.

"These young guys are looking for a home of their own," said Jeff Sikich, a biologist with the National Park Service. "At this age, they are testing their boundaries and establishing their home range away from other males."

Officials on Wednesday were studying hair and tissue sample and preparing genetic analysis that could help shed more light on his origins as a debate raged over whether police should have killed the lion.

He and other experts believe the lion was startled as the morning commute began and noise of the city rose. Mountain lions ? more so than bears or other animals ? are harder to deal with when they enter civilization because they tend to turn aggressive.

"When you stick a dart in a mountain lion, it becomes agitated. A 90-pound mountain lion can easily take down a 200-pound deer," said Kevin Brennan, a wildlife biologist with the California Department of Fish and Game.

The mountain lion was one of at least 10 in the Santa Monica Mountains, Sikich said. Last year, another male mountain lion was killed when it tried to cross the 405 Freeway near the Getty Center.

But that case caused none of the furor of the shooting, which on Wednesday led to calls for independent investigations and policy changes.

Animal rights activists and others questioned how authorities were able to tranquilize and safely remove a 400-pound bear that had frequented Glendale last month, but not able to do the same for the feline.

"They could have done more to help this animal live," said Rachel Hoffman, 64, of Marina del Rey. "It's just a big cat."

The mountain lion was first seen shortly before 6 a.m. Tuesday walking along Arizona Avenue. A janitor spotted him in the U-shaped courtyard of an office building, pawing at a glass door. The animal tried to approach the janitor, but he ran and called police.

Authorities made several attempts to contain the mountain lion in the courtyard, said Andrew Hughan, a spokesman for Fish and Game.

Wildlife agents fired several tranquilizing darts at the animal as the animal moved in the small space. Only one dart pierced the cat, he said. The animal became aggressive and tried to flee the courtyard, which was near a preschool.

"The more agitated the animal is, the longer it takes for the immobilizing drug to take," Brennan said. "You have to note the behavior of the animal after 10 minutes" and possibly administer more drugs.

Officers used non-lethal bullets and firefighters employed a water hose to contain the lion while they waited for the drug to take effect. During that time, the animal got close to a Santa Monica police officer and it was fatally shot.

Police have said they killed the cat to protect the public, noting that the cat could have harmed children and shoppers in the bustling Santa Monica downtown district.

For a decade, the National Park Service has been monitoring the habits of the cougars living in the Santa Monica Mountains. Biologist are tracking five lions with GPS radio collars. The slain mountain lion was one of a handful not outfitted with a tracking device.

Mountain lions rarely wander into urban communities, scientists said. But the animals have less room to roam as development encroaches on the their land.

"To be a mountain lion is to roam, and you can't disperse across Southern California without running into a city like Santa Monica," Brennan said.
